These Terms govern your use of swellpitch.com, Funnel Finder, pitch and report pages, guided demos, appointment scheduling, and related services operated by ScubaDev. By using the service, you agree to these Terms.
The service
Swell Pitch provides lead-magnet concepts, website analysis, mockups, pricing guidance, reports, demonstrations, scheduling, and custom build services. Funnel Finder outputs are preliminary creative and commercial recommendations, not a promise of performance or a final project scope.
Your information and permitted use
You confirm that you are authorized to submit the website and information you provide. You may use the service for lawful business purposes. You may not probe or disrupt the service, bypass access controls, submit malicious code, abuse automated requests, impersonate another person or company, infringe rights, or use outputs to mislead others.
Pitches, concepts, and intellectual property
You keep ownership of information and materials you submit. ScubaDev owns the Swell Pitch service, software, design system, catalog, demos, and pre-existing materials. You may review, share internally, and evaluate a pitch prepared for your domain. A concept hold is a limited commercial courtesy, not a transfer of intellectual property or a guarantee that no similar idea will ever be used elsewhere. Ownership and license terms for a paid build are set in the separate project agreement.
Paid builds
Any paid strategy, design, development, hosting, maintenance, AI usage, third-party fees, timeline, revisions, deliverables, ownership, cancellation, and payment terms will be governed by a separate proposal, order, or agreement. Prices shown in Funnel Finder are estimates or menu prices unless that separate agreement says otherwise.
Third-party services and communications
The service may use or link to third-party tools for crawling, AI, email, scheduling, hosting, analytics, and payments. Their terms and privacy practices apply to their services. By requesting a pitch or appointment, you agree to receive transactional messages needed to verify, deliver, and discuss that request. You can ask us to stop non-transactional follow-up at any time.
No professional advice or guarantees
Outputs are for business planning and marketing discussion only. They are not legal, financial, medical, security, engineering, tax, or other regulated professional advice. You are responsible for reviewing the accuracy, compliance, and suitability of any concept before relying on or publishing it. We do not guarantee leads, revenue, rankings, conversion rates, uptime, or a particular business result.
Disclaimers and liability
The service is provided "as is" and "as available" to the fullest extent permitted by law. ScubaDev disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the fullest extent permitted by law, ScubaDev will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the free service. Any liability tied to a paid build is governed by the separate project agreement.
Suspension, changes, and governing law
We may limit or suspend access when needed for security, abuse prevention, maintenance, or legal compliance. We may change the service or these Terms, with the updated date showing the latest version. These Terms are governed by California law, without regard to conflict-of-law rules. Courts located in Orange County, California will have exclusive jurisdiction where permitted.
